Terms of Service

1. Who this agreement is between

These Terms of Service ("Terms") are a legal agreement between you ("Customer," "you") and Subastian, LLC, a Colorado limited liability company ("Subastian," "we," "us," "our"). By using subastian.us, joining our waitlist, creating an account, subscribing to a paid plan, or joining our affiliate program, you agree to these Terms.

2. Pre-launch and the Founding Roster

Joining the Founding Roster (our free waitlist) costs nothing, needs no payment information, and does not obligate you to buy anything. Roster members may get early-access invitations, launch updates, and founding-member offers by email. You can leave anytime with the unsubscribe link in any email or by contacting us.

Features, pricing, and launch timing described on this site are our current plans, not a binding offer, and may change before launch. We intend to honor the launch pricing shown on this site for roster members who sign up before launch. The terms shown at checkout control any purchase.

3. What Subastian is (and isn’t)

Subastian is subscription-management software that helps you track recurring software subscriptions, get renewal reminders, and spot subscriptions you may not be using. A paid plan includes the features that are live in the app when you subscribe.

Subastian is not a bank or a financial advisor. It cannot cancel your subscriptions, dispute charges, or move money on your behalf unless a specific feature explicitly says so and you have separately authorized it.

4. Accounts

• Provide accurate information when you create an account, and keep your login credentials confidential.
• You’re responsible for all activity under your account.
• You must be at least 18 years old (or the age of majority where you live) to use Subastian.
• We may suspend or terminate an account that violates these Terms, is used fraudulently, or is used to abuse, scrape, or attack the service.

5. Plans, billing, and payment

• Subastian’s planned subscription plans are Starter, Conductor Pro, and Agency Maestro, billed monthly in advance unless checkout states otherwise. Current prices appear on our pricing section and at checkout.
• Orders are processed by Lemon Squeezy, our merchant of record. Lemon Squeezy is the reseller of the product to you, processes your payment, and collects and remits applicable sales tax or VAT. Your purchase is also subject to Lemon Squeezy’s buyer terms, shown at checkout. We never receive or store your full card number.
• Subscriptions renew automatically until canceled. You can cancel anytime from your account settings or from the subscription-management link in your Lemon Squeezy receipt email. Cancellation takes effect at the end of the current billing period.
• We’ll give active subscribers at least 30 days’ notice before a price change applies to their next renewal.
• If a payment fails, access may be paused until it is resolved.

6. Refunds

Refunds are covered by our Refund & Cancellation Policy, which is part of these Terms.

7. Acceptable use

You agree not to:

• Reverse-engineer, resell, or white-label Subastian without a separate written agreement.
• Store or process another person’s financial-account credentials in Subastian without their authorization.
• Try to access another customer’s data or interfere with how the service or this site works.
• Submit false information through our signup forms.
• Use the affiliate program in ways that break its terms, including making false or misleading claims about Subastian.

8. Your data

Our Privacy Policy is part of these Terms and explains how we collect, use, and protect your data. In short: you own the subscription data you enter, we don’t sell it, and you can export it or ask us to delete it.

9. Affiliate program

Subastian’s affiliate program runs on Lemon Squeezy’s affiliate platform. By joining, you also agree to the program terms shown when you apply and to Lemon Squeezy’s affiliate terms. Lemon Squeezy tracks referrals and pays commissions. If a referred order is refunded or charged back, the commission on it may be reversed.

10. Savings estimates

Any savings figures in our marketing or in the app are estimates based on the subscription data you enter or on illustrative examples. They are not a promise of any specific result.

11. Intellectual property

This site’s text, design, and branding, including the Subastian name and marks, belong to Subastian, LLC. You may view and share the site, but you may not copy its content and present it as your own.

12. Disclaimers and limitation of liability

Subastian is provided "as is" and "as available," without warranties of any kind, express or implied.

To the maximum extent the law allows, Subastian’s total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages. For example, if a missed renewal alert leads to an unwanted charge from a third-party service, we are not liable for that charge. You remain responsible for managing your own subscriptions.

13. Changes and governing law

We may update these Terms from time to time. For a material change, we’ll email active subscribers at least 14 days before it takes effect and update the date at the top of this page.

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
